Terms of Use

Effective date: July 12, 2026

These Terms of Use (the “Terms,” also serving as the End User License Agreement) are an agreement between you and ClearDay for your use of the ClearDay app. By downloading or using ClearDay, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the app.

1. Who may use ClearDay

You must be at least 16 years old, or the age of majority where you live if that is higher. By using ClearDay you confirm that you meet this requirement and that the information you provide is accurate.

2. Not medical advice

ClearDay provides behavioral and motivational support to help you reduce or stop smoking. It is not a medical device and does not provide medical advice, diagnosis, or treatment. The plans, tips, milestones, and tools are for informational and educational purposes only and are not a substitute for professional medical advice. Always talk to your doctor or another qualified health provider with any questions about your health, medications, or quitting. If you think you may have a medical emergency, contact your doctor or emergency services right away. You use ClearDay, and act on its content, at your own risk.

3. Your license to use the app

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use ClearDay on Apple devices that you own or control, for your own personal, non-commercial use, and as permitted by the App Store Terms of Service. This app is licensed, not sold, to you.

4. Your account

You can use ClearDay as a guest. If you create an account, you’re responsible for keeping your sign-in secure and for activity under your account. Let us know promptly if you believe your account has been used without your permission.

5. ClearDay Premium subscriptions

ClearDay offers an optional auto-renewable subscription, ClearDay Premium, which unlocks additional features such as the full Insights dashboard, the complete SOS toolkit, and a personalized plan.

6. Acceptable use

You agree not to misuse ClearDay — including by attempting to reverse engineer or extract its source, copying or reselling it, using it unlawfully, or interfering with its normal operation.

7. Your content

You keep ownership of the notes, check-ins, and other information you enter. You give us permission to store and process this information only to provide ClearDay to you, including syncing it and building your plan. You’re responsible for the accuracy of what you enter.

8. Our content

ClearDay, including its design, text, graphics, and logos, is owned by ClearDay or its licensors and is protected by intellectual property laws. Except for the license above, no rights are granted to you.

9. Disclaimers

ClearDay is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose. We do not warrant that the app will be uninterrupted or error-free, or that it will help you quit or reduce smoking. Results vary from person to person.

10. Limitation of liability

To the maximum extent permitted by law, ClearDay will not be liable for any indirect, incidental, special, or consequential damages, or any loss of data, profits, or goodwill, arising from your use of the app. Our total liability for any claim relating to the app will not exceed the greater of the amount you paid us in the 12 months before the claim or US$50. Some places don’t allow certain limitations, so some of the above may not apply to you.

11. Apple

These Terms are between you and ClearDay only, not Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide support or maintenance for the app. To the maximum extent permitted by law, Apple has no warranty obligation with respect to the app, and any claims that the app fails to conform to any warranty are ClearDay’s responsibility. Apple is not responsible for addressing any claims relating to the app, including product liability, legal or regulatory, or consumer protection claims. If a third party claims the app infringes their intellectual property rights, ClearDay (not Apple) is responsible for the investigation and resolution of that claim. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.

12. Ending these Terms

We may suspend or end your access if you break these Terms. You can stop using ClearDay at any time and delete your account from the app’s settings. Sections that by their nature should continue — such as those on medical disclaimers, content, disclaimers, liability, and Apple — will survive.

13. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules, except where the consumer-protection laws of your home country require otherwise. Disputes will be handled in the courts located in California, unless mandatory law provides otherwise.

14. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we’ll update the date above and, where appropriate, let you know in the app. Continuing to use ClearDay after an update means you accept the revised Terms.
